В целях дальнейшего совершенствования и оптимизации подготовки кадров за рубежом постановляю:

1. Утвердить прилагаемые:

1) Положение о Республиканской комиссии по подготовке кадров за рубежом;

2) состав Республиканской комиссии по подготовке кадров за рубежом.

1-1. Правительству Республики Казахстан утвердить Правила отбора претендентов для присуждения международной стипендии Президента Республики Казахстан "Болашак".

1-2. Руководителям центральных и местных исполнительных органов Республики Казахстан ежегодно не позднее 1 сентября представлять в рабочий орган Республиканской комиссии по подготовке кадров за рубежом заявку на подготовку специалистов по международной стипендии "Болашак".

2. Внести в некоторые акты Президента Республики Казахстан следующие изменения и дополнения:

1) в постановление Президента Республики Казахстан от 5 ноября 1993 года N 1394 "Об учреждении международных стипендий Президента Республики Казахстан "Болашак" для подготовки кадров за рубежом" (САПП Республики Казахстан, 1993 г., N 43, ст. 515):

в пункте 1:

в абзаце первом слова "250 международных стипендий" заменить словами "международную стипендию";

в абзаце втором слова "Кабинету Министров" заменить словом "Правительству";

в пункте 4 после слов "Министерство образования" дополнить словами "и науки";

пункт 5 признать утратившим силу;

2) утратил силу Указом Президента РК от 09.01.2006 N 1696 (вводится в действие со дня подписания).

3. Настоящий Указ вступает в силу со дня опубликования.

Положение о республиканской комиссии по подготовке кадров за рубежом

Глава 1. Общие положения

1. Республиканская комиссия по подготовке кадров за рубежом (далее - Республиканская комиссия) является консультативно-совещательным органом при Президенте Республики Казахстан и создается в целях реализации мероприятий по вопросам международной стипендии Президента Республики Казахстан "Болашак" (далее - международная стипендия "Болашак") и прохождения научных стажировок.

2. В своей деятельности Республиканская комиссия руководствуется Конституцией Республики Казахстан, актами Президента и Правительства Республики Казахстан, иными нормативными правовыми актами Республики Казахстан и настоящим Положением.

3. Состав республиканской комиссии утверждается Президентом Республики Казахстан. Возглавляет республиканскую комиссию Государственный советник Республики Казахстан. Заместителем председателя Республиканской комиссии является Министр науки и высшего образования Республики Казахстан, секретарем - заместитель Министра науки и высшего образования Республики Казахстан.

3-1. Рабочим органом Республиканской комиссии является Министерство науки и высшего образования Республики Казахстан.

Глава 2. Задачи республиканской комиссии

4. Основными задачами Республиканской комиссии являются:

1) выработка предложений по определению общей стратегии подготовки кадров за рубежом;

2) принятие решения о присуждении, лишении международной стипендии "Болашак" в соответствии с Правилами отбора претендентов для присуждения международной стипендии "Болашак" (далее – Правила отбора);

2-1) ежегодное определение категорий работников для участия в конкурсе на прохождение стажировки в зарубежных организациях в рамках международной стипендии "Болашак";

3) исключен Указом Президента РК от 16.07.2020 № 372;
4) исключен Указом Президента РК от 16.07.2020 № 372;

4-1) обеспечение координации вопросов трудоустройства выпускников программы "Болашак".

4-2) принятие решения о присуждении, лишении научной стажировки в соответствии с Правилами отбора претендентов и прохождения научных стажировок, утверждаемыми Правительством Республики Казахстан;

5) осуществление иных функций, необходимых для основной деятельности, не противоречащих законодательству Республики Казахстан.

Глава 3. Организация и порядок деятельности республиканской комиссии

5. Председатель Республиканской комиссии организует ее работу и обеспечивает координацию деятельности членов Республиканской комиссии в соответствии с законодательством республики и настоящим Положением.

5-1. В случае отсутствия председателя Республиканской комиссии его функции осуществляет заместитель председателя.

6. Секретарь республиканской комиссии представляет на рассмотрение республиканской комиссии документы и материалы, подготовленные рабочим органом.

7. Председатель, заместитель председателя, секретарь и члены республиканской комиссии принимают участие в ее работе на общественных началах.

8. Заседания республиканской комиссии проводятся в соответствии с планом ее работы. Внеплановые заседания проводятся по мере необходимости по решению председателя республиканской комиссии.

Заседания республиканской комиссии правомочны при наличии двух третей от общего числа членов комиссии.

9. Решение республиканской комиссии принимается открытым голосованием не менее чем тремя четвертями голосов от числа присутствующих на заседании членов комиссии.

10. Рабочий орган Республиканской комиссии:

1) устанавливает общие требования к содержанию личных дел претендентов на международную стипендию "Болашак";

2) исключен Указом Президента РК от 16.07.2020 № 372;

3) утверждает перечень родственных специальностей для обучения за рубежом в рамках международной стипендии "Болашак", список ведущих зарубежных высших учебных заведений, зарубежных организаций, рекомендуемых для обучения, прохождения языковых курсов обладателями международной стипендии "Болашак" (далее - стипендиат), таблицу эквивалентности оценок для присуждения международной стипендии "Болашак", таблицу продолжительности языковых курсов;

4) разрабатывает и утверждает нормы расходов на питание, проживание, приобретение учебной литературы, определяет вид и класс транспорта по проезду от места проживания до места обучения, прохождения языковых курсов либо стажировки на основании документов и/или иной информации, предоставленных соответствующими государственными органами зарубежных стран, зарубежными высшими учебными заведениями, зарубежными организациями, осуществляющими проведение языковых курсов и стажировок, статистическими, рейтинговыми и иными соответствующими организациями и/или определяемыми уполномоченными органами иностранных государств зарубежными организациями, оказывающими услуги по организации обучения;

5) утверждает сроки приема документов и проведения конкурса на международную стипендию "Болашак";

6) утверждает состав независимой экспертной комиссии по согласованию с заинтересованными государственными органами, высшими учебными заведениями, научными и иными организациями, порядок и организацию ее работы, а также лист оценки персонального собеседования претендентов с членами независимой экспертной комиссии;

7) устанавливает необходимый минимальный уровень знания государственного языка, необходимый минимальный уровень знания иностранного языка с учетом требований зарубежных высших учебных заведений, зарубежных организаций, определяемых уполномоченными органами иностранных государств;

8) вносит необходимые материалы к заседаниям Республиканской комиссии;

9) осуществляет иные функции, необходимые для обеспечения и реализации мероприятий по международной стипендии "Болашак" и научным стажировкам, не противоречащие законодательству Республики Казахстан;

10) создает комиссию по рассмотрению обращений обладателей международной стипендии "Болашак", за исключением вопросов, рассмотрение которых входит в компетенцию Республиканской комиссии в рамках осуществления ее задач, предусмотренных пунктом 4 настоящего Положения;

11) утверждает порядок и условия заключения договора на обучение/прохождение стажировки со стипендиатами, осуществления размещения стипендиатов, мониторинга успеваемости и осуществления трудовой деятельности стипендиатов, замены залогового имущества, предоставленного в качестве обеспечения исполнения обязательств стипендиатов, возмещения расходов, затраченных на стипендиата со дня вынесения Республиканской комиссией решения о присуждении международной стипендии "Болашак", включая оплату неустойки (штрафа);

12) принимает отказ от международной стипендии "Болашак" в соответствии с Правилами отбора, а также решение о предоставлении отсрочки от осуществления трудовой деятельности по специальности, полученной в рамках международной стипендии "Болашак", на территории Республики Казахстан;

13) ежегодно утверждает перечень приоритетных специальностей для присуждения международной стипендии "Болашак";

14) ежегодно устанавливает предельное количество международной стипендии "Болашак" для категорий лиц, определяемых Правилами отбора.

Глава 4. Порядок прекращения деятельности республиканской комиссии

11. Решение о прекращении деятельности республиканской комиссии принимается Президентом Республики Казахстан.

With a view to further improving and optimization the training of personnel abroad, I hereby resolve:

1. To approve the attached:

1) Regulations on the Republican Commission for training of personnel abroad;

2) composition of the Republican Commission for training of personnel abroad.

1-1. The Government of the Republic of Kazakhstan shall approve the Rules for selection of applicants for the award of the international scholarship of the President of the Republic of Kazakhstan “Bolashak”.

1-2. The heads of the central and local executive bodies of the Republic of Kazakhstan annually, no later than September 1, shall submit to the working body of the Republican Commission for training of personnel abroad an application for training specialists on the international scholarship of the President of the Republic of Kazakhstan “Bolashak”.

2. To introduce the following amendments and additions in some acts of the President of the Republic of Kazakhstan:

1) in Decree of the President of the Republic of Kazakhstan dated November 5, 1993 N 1394 "On the establishment of international scholarships of the President of the Republic of Kazakhstan “Bolashak” for training of personnel abroad" (CAPG of the Republic of Kazakhstan, 1993, N 43, art. 515):

In paragraph 1:

in the first sub-paragraph the words "250 international scholarships" shall be replaced by the words "international scholarship";

in the second sub-paragraph, the words "to the Cabinet of Ministers" shall be replaced by the word "to the Government";

in paragraph 4 the words "Ministry of Education" shall be supplemented by the words "and science";

paragraph 5 shall be recognized as terminated;

2) Terminated by Decree of the President of the Republic of Kazakhstan dated 09.01.2006 N 1696 (shall come into effect from the date of signing).

3. This Decree shall come into effect from the date of publication.

on the Republican Commission for training of personnel abroad
Chapter 1: General provisions

1. The Republican Commission for Personnel Training Abroad (hereinafter referred to as the Republican Commission) shall be an advisory and consultative body to the President of the Republic of Kazakhstan and shall be founded to implement measures on the issues of the Bolashak International Scholarship of the President of the Republic of Kazakhstan (hereinafter referred to as the Bolashak International Scholarship) and scientific internships.

2. In its activity, the Republican Commission shall be guided by the Constitution of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan and this Regulation.

3. The members of the Republican Commission shall be appointed by the President of the Republic of Kazakhstan. The State Counselor of the Republic of Kazakhstan shall head the Republican Commission. The Deputy Chairman of the Republican Commission shall be the Minister of Science and Higher Education of the Republic of Kazakhstan, the Secretary shall be the Deputy Minister of Science and Higher Education of the Republic of Kazakhstan.

Chapter 2: Objectives of the National Commission

4. The main tasks of the Republican Commission shall be:

1) development of proposals for defining a general strategy for training of personnel abroad;

2) making a decision on the award or withdrawal of the Bolashak International Scholarship in accordance with the Rules for the Selection of Applicants for the award of the Bolashak International Scholarship (hereinafter referred to as the Selection Rules);

2-1) annual determination of the categories of employees for participation in the competition for internships in foreign organizations within the framework of the international scholarship “Bolashak”;

3) excluded by the Decree of the President of the Republic of Kazakhstan dated 16.07.2020 № 372;
4) excluded by the Decree of the President of the Republic of Kazakhstan dated 16.07.2020 № 372;

4-1) ensuring coordination of issues of employment of graduates of the “Bolashak” program;

4-2) adopting a decision on the award, withdrawal of scientific internships under the Regulations for the Selection of Applicants and Scientific Internships, adopted by the Government of the Republic of Kazakhstan;

5) implementation of other functions necessary for the main activity, which do not contradict the legislation of the Republic of Kazakhstan.

Chapter 3: Organisation and functioning of the republican commission

5. The Chairperson of the Republican Commission shall organize its work and ensure coordination of the activities of the members of the Republican Commission in accordance with the legislation of the Republic and these Regulations.

5-1. In the case of absence of the Chairperson of the Republican Commission, his/her functions shall be performed by the Deputy Chairperson.

6. The secretary of the Republican Commission shall submit documents and materials prepared by the working body for consideration by the Republican Commission.

7. The Chairperson, Deputy Chairperson, Secretary, and members of the Republican Commission shall take part in its work on a voluntary basis.

8. Meetings of the Republican Commission shall be held in accordance with the plan of its work. Unscheduled meetings shall be held as required by the decision of the Chairperson of the Republican Commission.

The meetings of the Republican Commission shall be competent if two-thirds of the total number of members of the commission is present.

9. The decision of the Republican Commission shall be made by an open vote by at least three quarters of votes from the number of members of the commission present at the meeting.

10. The working body of the Republican Commission shall:

1) establish general requirements for the content of personal files of applicants for the “Bolashak” international scholarship;

2) excluded by the Decree of the President of the Republic of Kazakhstan dated 16.07.2020 № 372;

3) approve the list of related specialties for studying abroad within the framework of the international scholarship “Bolashak”, the list of leading foreign higher educational institutions, foreign organizations recommended for training, passing language courses by holders of the international scholarship “Bolashak” (hereinafter referred to as the Scholarship holder), the table of equivalence of grades for the award of the international scholarship “Bolashak”, the table of the duration of language courses;

4) develop and approve the norms of expenses for food, accommodation, purchase of educational literature, determine the type and class of transport for travel from the place of residence to the place of study, taking language courses or internships based on the documents and/or other information provided by the relevant state bodies of foreign countries, foreign higher educational institutions, foreign organizations carrying out language courses and internships, statistical, rating and other relevant organizations and/or foreign organizations determined by the authorized bodies of foreign states that provide training services;

5) approve the deadline for accepting documents and holding a competition for the international scholarship “Bolashak”;

6) approve the composition of the independent expert commission, in agreement with the interested state bodies, higher educational institutions, scientific and other organizations, the procedure and organization of its work, as well as the assessment sheet of the personal interview of applicants with members of the independent expert commission;

7) establish the required minimum level of knowledge of the state and foreign languages, the minimum threshold score for subject exams, taking into account the requirements of foreign higher educational institutions, foreign organizations, determined by the authorized bodies of foreign states;

8) submit the necessary materials for the meetings of the Republican Commission;

9) undertake other functions required to ensure and implement the Bolashak International Scholarship and Research Internship activities not inconsistent with the laws of the Republic of Kazakhstan;

10) create a commission to consider the applications of the holders of the international scholarship “Bolashak”, with the exception of issues, the consideration of which is within the competence of the Republican Commission in the framework of its tasks, provided for in paragraph 4 of this Regulation;

11) approve the procedure and conditions for concluding an agreement for training/internship with fellows, placement of fellows, monitoring the progress and implementation of labor activities of fellows, replacement of collateral provided as security for the fulfillment of obligations of fellows, reimbursement of expenses spent on the scholarship from the date of issuance of the Republican the Commission decided to award the international scholarship “Bolashak”, including the payment of a forfeit (fine).

Chapter 4. Procedure for terminating the activities of the republican commission

11. The decision to terminate the activities of the Republican Commission shall be made by the President of the Republic of Kazakhstan.
